Acceptance of terms

These Terms of Service ("Terms") are an agreement between you and the MixTube team ("we", "us", "our"). By downloading, installing or using the MixTube app ("App") or this website (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

The service

MixTube provides:

• AI music creation — songs composed by AI from your prompts, lyrics and chosen music styles
• Music library and player — listening to songs, including freely licensed AI-generated music
• Web browser — a built-in, unrestricted browser with search
• Saving and management tools — favorites, playback controls and saving images to your Photos library

AI music creation needs an internet connection and is processed in the cloud by our AI partner.

Eligibility

You must be at least 13 years old to use MixTube, and old enough for the age rating shown on the App Store. If you are under the age of majority where you live, you may use MixTube only with the permission of a parent or guardian.

Because the built-in browser can open any website, it may show content that is not suitable for everyone. Parents can use Screen Time to restrict web content.

Accounts

Most of MixTube works without an account. If a feature ever requires one, you are responsible for keeping your login details safe and for all activity under your account.

Acceptable use

Use MixTube only for lawful purposes. You must not:

• Create content that infringes copyrights, trademarks or other rights — for example by uploading or prompting with lyrics you have no rights to, or trying to copy a specific artist's protected songs or voice
• Create content that is illegal, hateful, harassing, sexually exploitative, violent or otherwise harmful
• Pass off AI-generated music as the work of a real artist, or use it to mislead people
• Create spam or use automated tools to send requests to the AI service
• Get around usage limits, safety filters or content moderation
• Use the browser to access illegal content or to carry out unlawful activity
• Reverse engineer, decompile, copy or resell the App, or interfere with how it works

Your content and AI-generated music

What you provide

You keep ownership of the prompts, lyrics and other material you provide. You give us and our AI partner permission to process that material only to create your music and to operate and protect the Service. You confirm that you have the right to use everything you provide.

What you create

Subject to these Terms, you may use the music you create with MixTube for personal and commercial purposes. Please keep in mind that:

• The AI may produce similar results for other users, so your song may not be unique.
• In some countries, music made by AI may not be protected by copyright.
• You are responsible for making sure your use of a song does not infringe anyone else's rights.

Music in the library

Songs in the MixTube music library that you did not create are published by others under their own licenses (for example public domain, CC0, CC BY or CC BY-SA, as shown in the player). If you use them outside MixTube, follow the license of each song, including its credit requirements.

AI service

• Availability: we aim for a reliable service but cannot guarantee that AI creation is always available or error-free.
• Results: AI output varies. We do not guarantee that a song will match your expectations, and it may contain mistakes.
• Fair use: we may set usage limits so the service stays fast for everyone, and may temporarily restrict heavy use.
• Moderation: we may refuse or remove requests and results that break these Terms.

Web browser

• The built-in browser is unrestricted. We do not control, review or endorse the websites you visit and are not responsible for their content, products or practices.
• You must follow the terms of the websites you use, and you are responsible for making sure anything you view, download or save complies with copyright law.
• Websites may ask to use your camera, microphone or location, or ask you to choose photos to upload. They can do so only if you allow it, and they handle that data under their own policies.
• We cannot guarantee protection against every online threat. Be careful with links, downloads and the information you enter on websites.

Subscriptions and payments

If MixTube offers paid features or subscriptions:

• Payment is charged to your Apple ID when you confirm the purchase.
• Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. You can manage or cancel them in your Apple ID settings; cancellation takes effect at the end of the current period.
• If a free trial is offered, any unused part of it ends when you buy a subscription.
• Refunds are handled by Apple under Apple's policies. You can request one at reportaproblem.apple.com.
• We may change prices with reasonable notice. Changes apply from your next billing period.

Intellectual property

The App, including its design, code, graphics, logo and the MixTube name, belongs to us and is protected by law. You may not copy, modify or distribute it except as these Terms allow. Open-source components in the App are covered by their own licenses.

Privacy

Our Privacy Policy explains what information MixTube uses, including for AI music creation, the browser, device permissions and Firebase services. By using MixTube, you agree to it.

Disclaimers

MixTube is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, uninterrupted or error-free operation, and the accuracy of AI-generated content or third-party websites.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of MixTube — including AI-generated content, content of websites you visit, and decisions you make based on them. Our total liability is limited to the amount you paid us for the Service in the 12 months before the claim. Some places do not allow these limits, so they may not fully apply to you.

Termination

You may stop using MixTube at any time by deleting the App; this removes the data stored on your device. We may suspend or end your access if you break these Terms, and we may change, pause or discontinue any part of the Service.

App Store terms

If you downloaded MixTube from Apple's App Store, these Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for claims relating to the App. Your use must also follow the App Store's usage rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where these Terms are silent, Apple's Standard End User License Agreement applies.

Changes to these terms

We may update MixTube and these Terms from time to time. When we change the Terms, we will update the "Last updated" date at the top of this page and, for important changes, let you know in the App. Continuing to use MixTube after a change means you accept the new Terms.

Governing law

These Terms are governed by the laws of the country where the MixTube team operates, without regard to its conflict-of-law rules. We will first try to resolve any dispute with you informally; if that fails, the dispute will go to the competent courts of that country, unless the law where you live gives you the right to bring it elsewhere.
